Second-Track Reintegration (Spoor 2)
Under the Wet verbetering poortwachter, an employer has to look beyond its own organisation once structural return to the original role stops being realistic. That search is spoor 2, the second track. Employers treat it as a step they are required to take. The letter that lands reads differently.
What spoor 2 requires
The employer bears the cost. Spoor 1, the search within the organisation, continues alongside it.
At the WIA application UWV assesses whether both parties made sufficient effort. Insufficient effort without properly evidenced grounds can extend the wage obligation by up to 52 weeks.
How it arrives for the employee
What most people take from the letter is that the organisation has decided their future and is now arranging the exit.
The letter does not say that. It states the legal obligation and the practical steps, and leaves the question of whether the employment continues open in both directions.
Open in both directions is the problem. Someone already on long-term sick leave fills that gap with the worst version, and then acts as though it has been confirmed.
What changes after that
Applications go out late, and the progress meetings get shorter each time.
Some of this is fear of what the search will confirm. There is also more to sort out than one person can manage, and often nothing gets done at all.
Where it becomes the employer’s problem
The file records the result rather than the reason. A second-track file with few applications and thin evaluations is the kind that gets treated as insufficient effort.
UWV expects an employer to notice this and act on it, and acting can mean suspending or stopping the employee’s wages. An employer who sees the cooperation drop and does nothing with it is the one carrying the sanction.
Hiring a reintegration agency does not settle it either. A 2025 court ruling upheld a sanction against an employer who had hired one and then stopped following the case themselves.
What would have changed it
The useful intervention sits before the cooperation drops away. Someone has to go through what the letter means with the person who received it, and separate what is accurate from what they have assumed.
After that comes the harder part. Someone in this position is weighing up every question at the same time. Whether they will work again, and what to tell their family. The work is to set most of that aside long enough to send one application.
That is rarely the case manager’s role, and it does not work coming from the employer either. It takes someone the employee can speak to honestly, who is not involved in assessing them.
Deciding this in advance
A route like that is quick to arrange and difficult to arrange once a case has already stalled. Workplace mental health support for organisations can sit alongside the arbodienst without taking over any part of the statutory process.

Sources: the Wet verbetering poortwachter as set out by UWV. Spoor 2 is required when structural return within the organisation is no longer realistic, and the employer bears the cost. UWV assesses both parties’ efforts at the WIA application, and the sanction is imposed on the employer, including where the shortfall originated with the employee, because the employer is expected to act on it. Dutch court ruling ECLI:NL:RBDHA:2025:1265 upheld a sanction against an employer who had engaged a professional reintegration agency and then left the process to them.
